In this article we will review some of the different options, effectiveness and estimated costs. Hopefully by the end, you’ll have an idea of how to move forward for your firm.
Understanding Cost Per Signed Case
If you are going to be buying mass tort leads, it’s important to understand the economics behind it.
Specifically, it’s important to understand how much it actually costs to sign a case, not just acquire leads. Then you also need to know how much you can likely make off a signed case. You will also want to know how many leads you need to sign a case.
Some of the numbers that you will need to include in your mass tort lead cost and case profit calculation are as follows:
- Projected settlement value
- Projected firm profit margin
-
- Close rate: % of leads that convert into signed cases
- Cost per lead
- Volume of leads needed
- Cost per signed case
- Costs you incur after signing a case
- Net difference between acquisition cost and expected case value
We will go through an example in the next section.
Example Framework
Here is an example framework you can use for your own case acquisition. This uses pretty conservative example numbers:
- Projected settlement value: $100,000
- Projected firm profit margin: 40%
- Expected firm value per case: $40,000
- Assumes a 40% contingency fee
- Close rate: 7.4%
- (This rate is an estimated “legal services sales close rate” from SmartWinnr.)
- This means fewer than 1 in 13 leads become signed cases.
- Cost per lead:
- $500
- Volume of leads needed for 1 signed case:
-
- 1 ÷ 0.074 = 13.5 leads
- Cost per signed case (acquisition cost):
-
- 13.5 × $500 = $6,750
Costs You Incur After Signing a Case
Signing a case is not the end of spending money to take the case through the legal process. Firms also face costs such as:
- Intake and staff time
- Medical record review
- Filing and litigation expenses
- Case management overhead
For this example, assume:
- Post-signing case costs: $8,000
Net Difference Between Acquisition Cost and Expected Case Value
Now compare the expected firm value to total costs.
- Expected case value to firm: $40,000
- Lead acquisition cost: $6,750
- Post-signing costs: $8,000
- Total cost to acquire and carry the case:
-
- $6,750 + $8,000 = $14,750
- Net difference (expected profit after costs):
-
- $40,000 − $14,750 = $25,250
So in our example, you’d make around $25,000 per case. This is assuming you had marketing costs of around $6,750 to obtain a case and $8,000 to run the case through your firm.

Lead Generation
Let’s first talk about lead acquisition options where you simply receive leads. This is where the entire process of generating the leads themselves is completely hands free and done by the marketing service provider. This is a great option for busy litigators who don’t have much time to deal with marketing.
Buying Leads
Legal marketing comes at a premium compared to marketing in other industries. Marketing in highly specific and complex niches like medical industries or toxic exposure usually require some expertise too.
So before you start buying leads, keep in mind, Mass Tort leads are not only:
- Subject to the premium costs of legal marketing industry,
- They are also related to some of the most potentially lucrative niches in the legal industry.
So they naturally cost much more for both reasons.
The Costs of Buying Mass Tort Leads
From our experience, mass tort leads can be:
- As low as $150-300 BUT good leads really cost more. For high quality mass torts leads you’re looking at around $400+ per lead, ranging into the thousands of dollars per lead.

- Legal leads cost up to $400 or more each.

This lead broker is offering to buy AFFF leads for $160. That means they must resell them for a lot more.
Lead Generation Campaigns
You may have noticed that on average it takes 13.5 leads to sign a case in the legal industry. This can really drive up your costs. But you may also wonder if the quality of the leads you receive is a lever you can pull to reduce your overall costs.
This lower cost per signed case is what lead generation campaigns can achieve for you. They can sometimes get you more signed cases for your money.
Lead generation campaigns are when a company runs a marketing campaign for you using their own assets. These may include their own websites, ads, creatives, videos, social media accounts and more. This is a high quality hands free service. This is the service we provide for law firms.

Marketing Campaigns
This is where a company does marketing for your firm. This is a great option for firms with huge budgets that want to grow their brands long term. It’s useful because it directly increases the marketing performance of your firm. You pay but the people who click ads or website links are clicking on assets owned by and branded for YOUR firm. This kind of marketing also builds your brand.
That’s a ton of upside, but let’s also cover some downsides, which are:
- High cost for the services.
- Time spent vetting, interfacing with and judging the marketing service provider.
- The prospect of paying for a service that doesn’t result in signed cases for your firm.
Agencies
A marketing agency is a company that does the marketing work for you. It’s basically an arrangement where you’d pay them monthly and they’d deliver marketing execution for you. Some examples of campaigns they may run for you:
- SEO – They optimize the code on your website and build content and video heavy web pages.
- Paid Ads – They run paid ads to a landing page on your website. Usually they will use Google, Facebook or YouTube ads.
- Social Media – They manage your social media account. They usually drive traffic to a landing page or an email signup.
- Email marketing – When a company uses various traffic methods to build an email list for you. They then email the users who subscribe and try to get them to contact the firm.
Note: An agency is not the same thing as a consultant. A consultant delivers marketing recommendations or strategies for you to implement on your own.
Traditional Media
Some media websites and outlets like TV also sell campaigns directly. This can be a good happy medium between a marketing service and a lead generation service.
This is a popular route. According to Thomson Reuters, lawyers and referral companies spent $67 million on mass tort TV advertising during a 5 month time period.
They will send traffic to your website or your phone. Make sure you’re prepared for that. Make sure someone is there to answer the phone.
If you send traffic to your website make sure the site is ready for people to be visiting it. You need to at least prepare a contact form on the page you tell them to send the traffic to. It’s also good to make sure your phone number is visible on the page.
DIY Marketing
You can do all the marketing yourself too. But you really need to consider the time and skill this takes. You will have significantly less time to do your lawyer related work if you are also executing marketing.
Why Is Mass Tort Lead Generation So Expensive?
There are a couple of reasons why mass tort lead generation is expensive. Let’s review some of them:
Saturated Ad Marketings, Ten-Million Dollar Budgets
Here is a summary based on a paper on Ad Tech from the University of Alabama Law. Legal marketing costs are high, and this paper ties that to how lawyer advertising has shifted into the modern internet ad economy. Platforms such as Google and Facebook control much of the advertising space, and law firms must compete there for visibility.
The paper points out that behavioral targeting and retargeting play a big role. This means users are tracked and shown repeated ads over time. Paying for that level of repeated exposure increases acquisition costs.
The paper says these pressures are especially strong in MDL mass tort litigation, where firms race to sign large numbers of clients and sometimes resemble high-volume “settlement mills.”
It also highlights that some firms spend tens of millions of dollars on advertising.
Since ethics rules mostly address deception, the paper argues since aggressive digital targeting is allowed, this keeps competition and costs climbing.
Mass Torts Attracts Many Firms
Mass Torts can be considered a big opportunity for personal injury firms. According to this paper, as of July 2024, MDL cases constituted roughly 65% of all civil cases pending in the U.S. District Courts.
A Factor Potentially Increasing Lead Volume Needed
A lot of leads go stale from follow up. It may be part of what contributes to needing more leads to sign a case. Consider these stats from Pew Research:
- Only 19% of Americans pick up calls from unknown numbers.
- 67% never answer unknown numbers but will listen to voicemail.
SEO Saturation
SEO is another marketing channel that mass tort lead gen companies use. According to SEO Tool BrightEdge, the legal vertical is one of the most competitive in search. We checked the SEO tool AHREFs, and saw that many SEO keywords for driving mass tort leads are rated as “very competitive.” This means the resources and skill to do SEO and win in mass torts are expensive.
